The decision of the Southern African Development Community (SADC) summit this weekend in Maputo to the protocol by which the SADC Tribunal was established, from the beginning to renegotiate and also now only room for the hearing of disputes between member states, is' a blow to democracy in the region.
The tribunal will decide according to the future not individuals, organizations or legal person who believes that they are not justice in their own countries by the legal system could find the power to hear cases.
The SADC summit reiterated nasa 2012 warning its reluctance shown to respond to not only its own charter, but also to international charters which human rights and in particular the right to access to court occupation, entrenched. Individuals' political, economic and social rights now rests in the hands of the country where they live and the overall power of the SADC Tribunal is gone.
It again appears that the hearing in support of democratic principles, an independent judiciary and judicial statement and in particular the true recognition of human rights merely lip service in the region. One step forward and then two steps back.
